21 LOCAL GOVERNMENT OMBUDSMAN - ANNUAL REPORT 2006/07
RESOLVED that the Local Government Ombudsman's annual report for 2006/07 be received.
22 NEW CODE OF CONDUCT - TRAINING AND NOTIFICATION OF PERSONAL INTERESTS
RESOLVED that the report be noted.
23 INVESTIGATION UNDER SECTION 66 OF THE LOCAL GOVERNMENT ACT 2000

21The Committee received the Local Government Ombudsman's annual report in respect of Reigate and Banstead Borough Council for the year ended 31st March 2007.

The report detailed the complaints against the Council received during 2006/07 by the Ombudsman (with a comparison with 2004/05 and 2005/06) and decisions on the complaints. Comments were also set out in respect of the Council's complaints procedure and handling of complaints, training in complaint handling, liaison with the Local Government Ombudsman (LGO) and LGO developments.

It was noted that the average response time to LGO enquiries had fallen and further improvement was anticipated for 2007/08.

A number of questions on the annual letter by Members of the Committee were answered following which it was
22The Head of Legal and Property Services (and Monitoring Officer) reported on the attendance of Borough Councillors at training (three separate sessions in partnership with Mole Valley and Tandridge) held during the Summer 2007 on the Council's new Code of Conduct.

It was a matter of concern that around 20 Councillors had not attended training on the Code, even more so as some of these were Members of Regulatory Committee(s). It was not feasible for the Monitoring Officer to provide one-two-one training and, in the circumstances, one further (and final) session on the new Code would be held in the New Year.

A letter would be sent to all Members on behalf of the Committee strongly recommending attendance, particularly by those Members that, to date, had received no training on the Code. At the same time, Group Leaders would be provided with the names of the Members who, according to records, had not attended the Summer sessions.

During discussion of this matter, the Committee noted that a centralised diary of events/meetings involving Members had now been created. The Committee also noted arrangements on New Member Induction, the Code of Conduct and Regulatory Services.

23The Committee reviewed and discussed the recent Hearing into an investigation under Section 66 of the Local Government Act 2000 and, in this respect, the Hearing Process Summary and Decision was circulated with the Agenda.

The officers had separately reviewed the process and outcome and a number of issues and improvements had been identified for further consideration/implementation. In relation to Members, the consensus was that the Hearing had gone well and the process followed was both fair and efficient.

During discussion of this matter, the Head of Legal and Property Services (and Monitoring Officer) indicated that a report would be submitted to a future meeting of the Committee on the next stage of the local "filtering" arrangements to be introduced from April 2008.
