26 APPLICATION FOR A PREMISES LICENCE;
GATEHOUSE STORES, ST ANNES DRIVE, REDHILL RH1 1AU

Decision

RESOLVED to GRANT the application for a new premises licence in respect of Gatehouse Stores, St Annes Drive, Redhill, in the terms as set out below:

Supply of alcohol for consumption off the premises (section J)
0700 hrs to 2200 hrs Sunday to Thursday
0700 hrs to 2300 hrs Friday and Saturday

Opening Hours (section L)
0700 hrs to 2200 hrs Sunday to Thursday
0700 hrs to 2300 hrs Friday and Saturday

Conditions to be imposed on the Licence:

1. A CCTV system must be installed on the premises to the standards required by Surrey Police. The system is to be fully maintained at all times with monthly maintenance checks being undertaken and operational at all times when the premises are open and undertaking licensable activities. The system must cover all internal public areas and immediate exterior of the premises aimed at preventing crime and disorder. At least one camera shall provide clear images of people entering and leaving the premises. All staff must be fully trained in the operation of the system and a record kept of this training including a record of system maintenance retained on the premises for inspection by any responsible authority on request. There must always be a member of staff on the premises able to operate the system when the premises are open and carrying out any licensable activity. All CCTV footage to be retained for a minimum of 31 days and made available either for viewing or in a format that can be downloaded within 24 hours of any request being made by a Police officer or authorised person. Applicable from one month after issue of licence.

2. An age verification policy shall be implemented and specify the age of 25 instead of 178 so as to require that any person who appears to be under the age of 25 shall be asked to provide proof of age in the required format before being sold or served alcohol.

3. An incident log is to be maintained and made available to any responsible authority upon request.

4. A refusals log is to be maintained and made available to any responsible authority upon request.

5. All staff members engaged, or to be engaged, in selling alcohol on the premises shall receive training in age-restricted sales. Induction training must be completed and fully documented prior to the sale of alcohol by the staff member and refresher training thereafter at intervals of no less than eight weeks. All age-restricted sales training shall be fully documented and recorded. All training records shall be made available to Surrey Police and Surrey Trading Standards on request.

6. A minimum of two members of staff shall be visibly employed at the premises as follows:
1800 hrs to 2200 hrs Sunday to Thursday
1800 hrs to 2300 hrs Friday and Saturday

Reasons for the Decision

1. The Sub-Committee had reviewed all the papers contained in the report circulated with the agenda.

2. The Sub-Committee paid careful attention to all the submissions made orally during the hearing, by Surrey Police as a responsible authority and by the applicant.

3. The Sub-Committee noted that none of the people who had made representations attended the meeting.

4. The Sub-Committee took into account the Council's own Statement of Licensing Policy, the Guidance issued by the Secretary of State under s.182 of the Licensing Act 2003, the individual merits of the case, Human Rights legislation, in particular Article 78 and Article 1 of the First Protocol, and the rules of natural justice.

5. The Sub-Committee considered that the Police had demonstrated to their satisfaction that their representations relating to the promotion of the crime and disorder licensing objective were persuasive.

6. The Sub-Committee noted that the applicant had been proactive regarding the security of the premises and that he had 16 cameras installed.

7. The Sub-Committee considered that the applicant had satisfactorily responded to the concerns raised in the representations by offering to reduce the opening hours.

8. The Sub-Committee considered that the application, as granted with conditions, met the four licensing objectives.

26The Sub-Committee considered an application for a premises licence in respect of the above premises.

The application was as set out in the agenda papers and summarised below:

Six letters of representation had been received, as set out in Annex 4 to the report.

Surrey Police had also made representations on the grounds of prevention of crime and disorder, and proposed a number of conditions to deal with these concerns, as set out in Annex 5.

A copy of the applicant's email accepting the proposed Police conditions was also attached at Annex 5.

The applicant attended the hearing.

Mr Murrae Hume, representing Surrey Police, attended the hearing.

In the course of his presentation, and in response to the representations from local residents, the applicant offered to amend his application as follows:

The applicant had a CCTV system installed with 16 cameras and he was happy to accept all the conditions proposed by Surrey Police.

The applicant, his wife and brother-in-law, all held a personal licence, staff would received regular training on the sale of alcohol to make sure there were no under-age sales, and the sales register would also flash a warning to check on age whenever alcohol was sold.

On behalf of Surrey Police, Mr Hume confirmed that he had nothing further to add.
