APPLICATION FOR A PREMISES LICENCE
in respect of MRS SMITH'S TEA ROOM, 45 NORK WAY, BANSTEAD

GRANTED AS APPLIED FOR and set out below:

Supply of alcohol on and off the premises (section J):

Hours premises are open to the public (section L:)

Reasons for the decision

The Sub Committee considered all the evidence submitted, both in the written application and representations and during the oral submissions at the hearing.

It noted that the two persons having made written representations did not attend the hearing.

In reaching its decision it took into consideration:

i. All papers and evidence relevant to their consideration of the application based upon the four licensing objectives.

ii. The Council's own Statement of Licensing Policy, the Guidance issued by the Secretary of State under s.182 of the Licensing Act 2003, Equality Act 2010, the individual merits of the case, Human Rights legislation and the rules of natural justice;

and considered that the application as granted met the four licensing objectives, based upon the relevant evidence and guidance.

It was noted that the written decision hereby issued takes precedence over the drafted decision released verbally at the close of the hearing.

The Committee considered an application for a premises licence at the above premises.

The licensing officer presented the application. In doing so, he advised the Sub Committee that a late representation had been received from the Chairman of the Nork Resident Association in support of the application. It was not included in the papers because it had been submitted too late.

The applicant attended the hearing and explained that the premises currently operated as a tea room and an occasional function venue, catering primarily for mature adults.

The application was in response to demand from customers to have a place where they could meet friends in the evening, and enjoy a glass of wine or similar with a food platter.

The applicant also sought to be able to provide alcohol for toasts or similar at events such as birthday and anniversary celebrations.

There was no bar on the premises and there was no intention to operate as an off-licence.

The application for off-site sales was to be able to include alcohol in the hampers available to order or on sale in the shop area.

The premises were normally open from Monday to Saturday but the application was for Monday through to Sunday to allow for the occasional function booking on a Sunday.
