RECOMMENDED that members of the Press and public be excluded from the meeting for the following items of business under Section 100A(4) of the Local Government Act 1972 on the grounds that:

RESOLVED that the Press and public be excluded from the meeting for item 21 under Section 100A(4) of the Local Government Act 1972 on the grounds that:
(i) it involved the likely disclosure of exempt information as defined in paragraph 1 of Part 1 of Schedule 12A of the Act; and
(ii) the public interest in maintaining the exemption outweighed the public interest in disclosing the information.

22The Committee considered a report on an application for a private hire driver's licence that included a copy of the relevant application form, copies of correspondence and other documents relating to the application together with extracts from the Department of Transport Circular 2/92 and Home Office Circular 13/92 relating to the disclosure of criminal records.

The hearing followed the procedure as set out in Appendix B to the report.

In the course of the officer's presentation, it was noted that the transcription of the applicant's letter, in support of his application, contained minor typographical errors which were corrected at the meeting.

The applicant (Ref. No. ***) attended the meeting and made representations to the Committee in support of the application. Further details were supplied by the applicant and by officers in response to queries raised by Members.

At 7.51 p.m. the Committee accompanied by the legal representative deliberated in private session.

Following consideration of the issues involved in the application, the meeting reconvened at 8.24 p.m. and the Chairman announced the Committee's decision.

The Committee had given due consideration to the applicant's documents and submission, however, its overriding consideration was protection of the public .

It was of the opinion that there were no particular special circumstances in support of the application that would outweigh the guidelines issued by the Metropolitan Police and outlined in Annex 3 to the report.
