14 DECLARATIONS OF INTEREST

15 REVIEW OF TAXI AND PRIVATE HIRE LICENSING POLICY AND CONDITIONS
RESOLVED,

(1) that the current age restrictions be maintained for vehicle licensing applications at first registration;

(2) that the procedure as set out in Annex 1 be adopted for determining applications to license ‘exceptional' vehicles of between four and five years of age on first registration;

RECOMMENDED,

(3) that the Head of Community Safety and Environmental Health be delegated authority to determine applications for exceptional vehicles up to five years of age at first registration and that the Scheme of Delegations within the Constitution be amended accordingly.
16 REVIEW OF A PRIVATE HIRE OPERATOR'S LICENCE

RESOLVED, that the Committee note that:

(a) the formal review undertaken by Officers had confirmed that the operator was in compliance with the terms of the licence;
(b) the required conditions to be attached to the licence had been agreed and implemented; and

(c) Officers had renewed the operator's licence for one year under delegated authority.

15At its meeting on 17 June 2009 the Committee considered a report prepared by the Policy Advisory Group set up to review current licensing policy. The report set out a number of recommendations intended to enhance existing practice thereby making it more efficient and robust.

The Committee supported the recommendations in the report but asked for a further report expanding upon the proposal to delegate powers to Officers to determine applications for vehicles between four and five years of age at first registration where the condition was deemed to be so exceptional as to merit waiving the normal age criteria. In particular, the Committee wished to see clear guidelines established setting out the criteria under which a vehicle could be considered as ‘exceptional'.

Annex 1 to the report before the Committee set out the recommended inspection checklist to be used in conjunction with the Exceptional Vehicle Age Policy.

Annex 2 to the report outlined a diagrammatic Vehicle Inspection Report to be completed as part of the inspection procedure.
16At its meeting on 14 January 2009 the Committee agreed to renew the above operator's licence for six months, subject to the agreement and attachment of a number of conditions and to a formal review being undertaken by Officers after three months.

The Committee was advised that Officers had undertaken the formal review as required; that a number of test purchases had also been made and that the operator had been found to be in compliance with the conditions of the licence.

All the required conditions, including a management plan, had also been agreed and attached to the licence.

In these circumstances, and in consultation with the Chairman, Officers had renewed the licence for one year under delegated powers.
